These Terms & Conditions govern your access to and use of the Savoirvivrée website and your purchase of products from us.

Throughout these Terms & Conditions, “Savoirvivrée”, “we”, “us” and “our” refer to Savoirvivrée. “You” and “your” refer to any visitor, customer or person using our website or purchasing products from us.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms & Conditions. Please read them carefully before using the website or placing an order.

1. About Us

Savoirvivrée is a fashion brand offering products including dresses, shoes, bags and accessories.

Our website is operated using Shopify and may use third-party providers to support website hosting, payment processing, order fulfilment, delivery, analytics and other services.

2. Eligibility to Use the Website

You must be at least 18 years old to place an order through the website.

By placing an order, you confirm that:

  • you are legally capable of entering into a binding contract;

  • you are authorised to use the selected payment method; and

  • you are purchasing products for lawful purposes.

  • notifying us promptly if you believe your account has been compromised.

We are not responsible for losses caused by your failure to keep your account credentials secure, except where the loss results from our own failure to exercise reasonable care.

We may suspend or close an account where we reasonably suspect fraud, misuse, unlawful activity or a serious breach of these Terms & Conditions.

5. Product Information

We take reasonable care to ensure that product descriptions, photographs, sizes, colours, materials, prices and other details displayed on the website are accurate.

However:

  • colours may appear differently depending on your screen, device and display settings;

  • handmade, natural or individually finished products may have minor variations;

  • measurements and sizing information are approximate unless stated otherwise;

  • packaging may differ from images shown on the website; and

  • product availability may change without notice.

Minor variations that do not materially affect the product’s quality, appearance or intended use will not normally be considered defects.

Nothing in this section limits your legal rights where a product is faulty, not as described or not fit for its intended purpose.

6. Product Availability

All products are subject to availability.

Adding a product to your basket does not reserve it. A product may become unavailable before your order is accepted.

We may limit the quantity of a product that can be purchased by one customer, household, account, payment method or delivery address.

If a product becomes unavailable after you place an order, we will notify you and refund the amount paid for that product.

7. Placing an Order

When you submit an order, you are offering to purchase the selected products subject to these Terms & Conditions.

After placing an order, you may receive an acknowledgement email. This confirms that we have received your order but does not necessarily mean that we have accepted it.

A binding contract is formed when we:

  • send you an order confirmation stating that your order has been accepted; or

  • dispatch the products to you,

whichever happens first.

Each accepted order forms a separate contract between you and Savoirvivrée.

Please review your order, delivery address, email address, size, colour and other selections carefully before submitting payment.

8. Refusing or Cancelling an Order

We may refuse, limit or cancel an order before dispatch where:

  • a product is unavailable;

  • the product or price was displayed incorrectly;

  • we cannot authorise or verify payment;

  • we reasonably suspect fraud or unauthorised activity;

  • you have provided incomplete or inaccurate information;

  • delivery is not available to your location;

  • an order exceeds applicable purchase limits;

  • the order appears to be placed for unauthorised resale; or

  • accepting the order would breach a legal or regulatory requirement.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product or order.

Where a pricing error is obvious and could reasonably have been recognised as an error, we are not required to provide the product at the incorrect price.

9. Prices and Taxes

Prices are displayed in the currency shown on the website at the time of purchase.

Unless stated otherwise:

  • prices include applicable UK VAT where required;

  • delivery charges are not included in the product price;

  • delivery charges will be displayed before you complete checkout; and

  • international customs duties, import taxes and local charges may not be included.

Prices and promotions may change at any time, but changes will not affect orders that we have already accepted.

The price charged will be the price displayed at checkout, subject to correction of obvious errors.

10. Payment

Payment must be made using one of the payment methods available at checkout.

Payments may be processed by Shopify Payments, PayPal or other third-party payment providers. We do not directly store complete payment-card information where payment is processed by an authorised payment provider.

By submitting payment details, you confirm that:

  • the information is accurate;

  • you are authorised to use the payment method; and

  • sufficient funds or credit are available.

Payment may be taken when you place the order or when the order is processed, depending on the payment method.

If a payment is declined, reversed or suspected to be fraudulent, we may suspend or cancel the order.

11. Promotions and Discount Codes

Promotional offers and discount codes are subject to any additional conditions communicated with the offer.

Unless stated otherwise:

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • discount codes cannot be applied retrospectively;

  • offers may exclude certain products, collections or delivery charges;

  • offers are available for a limited period;

  • discounts cannot be combined; and

  • we may cancel or correct a promotion affected by an error, misuse or fraud.

Your statutory rights are not affected by the purchase of a discounted or sale product.

12. Delivery

We deliver to the locations available at checkout.

Available delivery methods, estimated times and charges will be shown during checkout. Delivery estimates begin after an order has been processed and dispatched.

Delivery dates and times are estimates unless we have expressly agreed to a guaranteed delivery date.

We will take reasonable steps to deliver your order within the stated timeframe and, unless otherwise agreed, within 30 days after the order is accepted.

Delays may occur because of:

  • courier or postal disruption;

  • customs processing;

  • adverse weather;

  • public holidays;

  • incorrect or incomplete delivery details;

  • high order volumes;

  • stock or fulfilment issues;

  • events outside our reasonable control; or

  • delivery restrictions in the destination country.

Please contact us if your order has not arrived within the estimated timeframe.

13. Delivery Information and Failed Delivery

You are responsible for providing a complete and accurate delivery address.

We are not responsible for delays or failed delivery caused by incorrect, incomplete or outdated information supplied by you.

If an order is returned to us because:

  • the address was incorrect or incomplete;

  • delivery was refused;

  • the parcel was not collected;

  • the recipient was unavailable after reasonable delivery attempts; or

  • applicable duties or charges were not paid,

we may refund the product price after deducting reasonable and non-recoverable delivery, return, customs or handling costs, where permitted by law.

We may require payment of additional delivery charges before resending an order.

14. Risk and Ownership

Responsibility for the products passes to you when the products are delivered to:

  • you;

  • a person identified by you to receive them; or

  • a safe place or collection location specifically authorised by you.

Ownership of the products passes to you once we have received payment in full.

15. International Orders, Customs and Import Charges

International orders may be subject to customs duties, import taxes, clearance charges and local fees imposed by the destination country.

Unless expressly stated at checkout, these charges are not included in the product price or delivery charge and are your responsibility.

We do not control these charges and cannot predict their amount. You should contact the relevant customs authority before ordering if you require further information.

You are responsible for ensuring that products ordered from us comply with the laws and import rules of the destination country.

Delays caused by customs authorities are outside our reasonable control.

16. Your Right to Cancel an Online Order

If you are a consumer purchasing online, you may have a legal right to cancel your order without giving a reason.

For most products, you may notify us that you wish to cancel from the date the order is placed until 14 days after the day on which you, or a person nominated by you, receives the products.

Where an order contains multiple products delivered separately, the cancellation period ends 14 days after the day on which the final product is received.

To cancel, email savoirvivree123@gmail.com and clearly state:

  • your name;

  • your order number;

  • the product or products being cancelled; and

  • that you wish to cancel the order.

You may use any clear written statement. You are not required to use a specific cancellation form.

If your order has already been dispatched, you must return the products in accordance with the return instructions provided by us.

17. Thirty-Day UK Returns Policy

In addition to your statutory cancellation rights, we offer qualifying UK customers a voluntary 30-day return period.

To qualify for this policy:

  • the return request must be made within 30 days of delivery;

  • the product must be returned in its original, unused and resalable condition;

  • all tags, labels, protective materials and original packaging must remain attached or included;

  • clothing must not have been worn beyond what is reasonably necessary to check fit;

  • shoes must only have been tried on indoors on a clean, soft or carpeted surface;

  • products must be free from stains, odours, makeup, deodorant, perfume, pet hair, damage and alterations; and

  • proof of purchase must be provided.

Qualifying UK returns will be free where we provide a prepaid return method or return label.

The voluntary 30-day return policy does not reduce or replace your statutory rights.

Products returned after the statutory 14-day cancellation period but within our voluntary 30-day period are subject to the conditions in this section. Original delivery charges may not be refundable for returns made solely under the voluntary policy.

18. Returning Cancelled Products

After notifying us of a statutory cancellation, you must return the products without undue delay and no later than 14 days after notifying us.

Please contact us before sending a return so that we can provide the correct return address and instructions.

You are responsible for taking reasonable care of the products while they are in your possession.

You may inspect a product in the same way you would reasonably inspect it in a physical shop. We may reduce the refund to reflect any loss in value caused by handling beyond what is reasonably necessary to establish the product’s nature, characteristics and fit.

You are responsible for the return until it reaches us. We recommend obtaining proof of postage and using a tracked service.

For international change-of-mind returns, you will normally be responsible for return delivery costs unless we state otherwise or the product is faulty, damaged or incorrect.

19. Products That Cannot Be Returned for Change of Mind

Unless faulty or otherwise required by law, we may not accept change-of-mind returns for:

  • products made to your specifications;

  • personalised or customised products;

  • products altered at your request;

  • sealed products that are not suitable for return for health or hygiene reasons once unsealed;

  • pierced jewellery where a hygiene seal has been removed;

  • underwear, swimwear or similar intimate products where the hygiene protection has been removed;

  • products damaged through misuse, improper care or normal wear and tear; or

  • products returned without essential components or in a condition that prevents resale.

These exclusions do not apply where a product is faulty, misdescribed or where applicable law gives you a right to return it.

20. Refunds

For a valid statutory cancellation, we will refund:

  • the price paid for the returned products; and

  • the cost of the least expensive standard delivery method offered by us, where applicable.

If you selected an enhanced or express delivery method, we are not required to refund the additional cost above standard delivery.

We may withhold the refund until:

  • we receive the returned products; or

  • you provide reasonable evidence that the products have been sent back,

whichever occurs first.

Refunds will normally be issued within 14 days after the relevant condition above has been met.

Refunds will be made to the original payment method unless otherwise agreed. Processing times after a refund is issued may depend on your bank or payment provider.

We may make a reasonable deduction where the value of a returned product has been reduced by unnecessary handling, damage or use.

21. Faulty, Damaged or Incorrect Products

Please inspect your order promptly after delivery.

Contact us as soon as reasonably possible if a product:

  • arrives damaged;

  • is faulty;

  • is not as described;

  • is not fit for its intended purpose;

  • is missing from the order; or

  • is different from the product you ordered.

Please provide your order number, a description of the issue and, where reasonably requested, photographs showing the problem.

Where a product is faulty, damaged or incorrect, we may offer an appropriate remedy, which may include:

  • replacement;

  • repair, where appropriate;

  • a price reduction; or

  • a full or partial refund.

We will cover reasonable return costs for products confirmed to be faulty, damaged or incorrectly supplied.

Nothing in these Terms & Conditions limits your rights under applicable consumer law.

22. Exchanges

Exchanges are subject to stock availability.

We may process an exchange as:

  • a return of the original product; and

  • a separate order for the replacement product.

If the requested size, colour or product is unavailable, we may issue a refund instead.

Price differences and additional delivery charges may apply.

23. Care of Products

You are responsible for following any washing, storage, cleaning, maintenance and care instructions supplied with the product.

We are not responsible for damage caused by:

  • failure to follow care instructions;

  • incorrect washing, drying, ironing or cleaning;

  • accidental damage;

  • improper storage;

  • ordinary wear and tear;

  • misuse;

  • unauthorised repair or alteration; or

  • use for a purpose for which the product was not designed.

This does not affect your rights where the product was faulty when supplied.

24. Intellectual Property

All content made available through the website, including the Savoirvivrée name, branding, logos, product names, photographs, graphics, videos, designs, text, layout and software, is owned by or licensed to Savoirvivrée and is protected by intellectual-property laws.

You may access and use the website for personal, non-commercial purposes.

You must not reproduce, distribute, publish, modify, sell, license, commercially exploit or create derivative works from our content without our prior written permission.

No right, title or interest in our intellectual property is transferred to you through your use of the website.

25. Reviews and User-Generated Content

The website may allow customers to submit reviews, photographs, comments or other content.

By submitting content, you confirm that:

  • you own it or have permission to submit it;

  • it is accurate and based on a genuine experience;

  • it does not infringe another person’s rights;

We may remove or refuse content that violates these Terms & Conditions, but we are not required to monitor all user-generated content.

We are not responsible for third-party websites, services, availability, content or security, except where applicable law provides otherwise.

The inclusion of a third-party link does not necessarily mean that we endorse that third party.

28. Website Availability

The website and products are intended for personal and domestic use. We are not responsible for business losses, including loss of profit, revenue, opportunity, goodwill, contracts or business interruption, where you use products for commercial or resale purposes.

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of rights that cannot legally be excluded; or

  • any other liability that cannot be limited under applicable law.

Your statutory consumer rights are not affected.

30. Events Outside Our Control

We are not responsible for delay or failure caused by events outside our reasonable control, including:

  • natural disasters;

  • extreme weather;

  • fire or flood;

  • epidemic or pandemic;

  • war, terrorism or civil disorder;

  • government action or restrictions;

  • customs delays;

  • strikes or industrial disputes;

  • transport or courier disruption;

  • interruption of telecommunications, internet or payment systems; or

  • supplier or fulfilment disruption outside our reasonable control.

We will take reasonable steps to minimise the effect of the event and will contact affected customers where appropriate.

31. Changes to These Terms & Conditions

We may update these Terms & Conditions from time to time to reflect changes in:

  • payment or delivery arrangements;

  • legal or regulatory requirements; or

  • security and operational practices.

The Terms & Conditions in force when we accept your order will normally apply to that order, unless a change is required by law.

Any transfer will not reduce your rights under the contract.

The remaining provisions will continue in full force and effect.

A waiver will only be effective if confirmed by us in writing.

35. Third-Party Rights

These Terms & Conditions are between you and Savoirvivrée.

Except where expressly stated, no other person has the right to enforce any part of these Terms & Conditions.

36. Entire Agreement

These Terms & Conditions, together with the order confirmation, Privacy Policy, Returns & Delivery Policy and any specific terms displayed for a product or promotion, form the agreement between you and us relating to your order.

Nothing in this section limits liability for fraud or fraudulent misrepresentation.

37. Governing Law and Jurisdiction

These Terms & Conditions and any contract between you and Savoirvivrée are governed by the laws of England and Wales.

If you live in England or Wales, the courts of England and Wales will have jurisdiction.

If you live in Scotland, you may bring proceedings in the courts of Scotland or England and Wales.

If you live in Northern Ireland, you may bring proceedings in the courts of Northern Ireland or England and Wales.

If you live outside the United Kingdom, you may also benefit from mandatory consumer protections in the country where you live. Nothing in these Terms & Conditions removes rights that cannot legally be excluded.
